?Which part of ?make no law? don?t you understand?, some people colorfully argue. Well, I understand ?make no law? just fine?. The real difficulty is with ?the freedom of,?? Mr. Volokh writes.

In the Founders? era, ?nearly everyone, as best I can tell, saw ?freedom of speech? and ?freedom of the press? as providing less than complete constitutional protection for spoken or printed words. And this suggests that the term ?freedom of? referred to some understanding that there is a proper scope of such freedom (even if the scope was unsettled in some particulars), rather to unlimited freedom to say or print anything one pleases.?

Volokh notes that there are clear problems with absolute protection for speech.? ?A threat to kill the President is literally speech. So is ?your money or your life,? said to someone in a dark alley?. Attempted fraud is often nothing but speech. The list could go on.

?There are, I recognize, arguments for barring the government from punishing any of this speech.? But if one is to appeal to the wisdom of ?the Founders,? one should recognize that the Founders almost certainly did not understand ?the freedom of speech, or of the press? as embracing absolute protection for speech and press.?

Respected for her ideas

Pakistan is unlikely to be first to spring to mind for Westerners considering gender equality.? But in a reflective article written by Hani Yousef for Himal Southasian, the Pakistani journalist notes that she feels better treated at home than in Germany, where she has worked since early 2011.

Ms. Yousef recounts a recent conversation she had with an Austrian woman at a party in Berlin. ?When I mentioned I was from Pakistan, her reaction was the oft-expressed assumption that it must be very difficult to be a woman there. I have lived and worked in journalism in Berlin for a year and a half, and the experience has made me appreciate the way I am treated back home as a career woman. I told her as much ? that I find that I am more respected back home.

?Conversely, visiting Pakistan this winter after a year of living in Germany, I was overwhelmed by the respect I got for being a woman of intelligence. People ? men, women, professors, analysts and relatives ? wanted to know what I thought of the Euro crisis, and what my take was on political issues. ? At a book festival in Karachi, an important defence analyst, a man, overheard my remarks about British analyst Anatol Lievin?s new book about Pakistan, and sought me out after the reading to ask if I had considered writing my views. The shock and surprise I experienced when he approached me made me realise how my self-esteem as a woman journalist had suffered in Germany."

Prosecutors argue for access to Holmes' notebook

DENVER (AP) ? Prosecutors are expected to argue that they should get a notebook sent by the Colorado theater shooting suspect to a university psychiatrist because it wasn't meant for therapy.

Prosecutors are to present their arguments and witnesses at a hearing Thursday in the James Holmes case.

Prosecutors suffered a setback Aug. 30 in obtaining the notebook that reportedly contains descriptions of an attack. A judge ruled that prosecutors could not disprove a doctor-patient relationship between Holmes and Dr. Lynne Fenton.

Holmes is charged with murder and attempted murder in the July 20 shooting that killed 12 and wounded 58 at an Aurora movie theater.

Prosecutors argued in court that the notebook wasn't meant for therapy because Holmes planned to be dead or in prison.

Witnesses say woman claimed to be at "Fatal Vision" murders

WILMINGTON, North Carolina (Reuters) - Several witnesses testified on Tuesday that a now-dead woman with a history of drug abuse told them she was at the home of an Army doctor on the night his family was killed 42 years ago, evidence he hopes will bolster his claim that he is innocent of the notorious murders that inspired a best-selling book.

Former Green Beret Jeffrey MacDonald, 68, is serving three life sentences for the deaths of his pregnant wife and two young daughters in their Fort Bragg, North Carolina, apartment in February 1970.

MacDonald has always insisted the murders were committed by drug-crazed intruders, including a blonde woman who he said carried a candle and chanted "acid is groovy, kill the pigs" while three men attacked him and killed his wife, Colette, and daughters Kristen and Kimberley, ages 2 and 5.

MacDonald, whose case inspired the bestseller "Fatal Vision," this week is asking a federal judge in Wilmington to give him a new trial based on evidence collected since his 1979 conviction.

An appeals court ruled last year that the evidence, including DNA results from unidentified hair found at the crime scene, must be weighed in light of all the other facts previously gathered rather than considered piecemeal.

A key focus of the defense case is the now-deceased Helena Stoeckley, who is thought by MacDonald's supporters to be the woman he said witnessed the murders.

At MacDonald's trial, Stoeckley testified that she could not remember what she was doing that night and had no recollection of being in the house. But witnesses who testified on Tuesday said she told them a different story.

Wendy Rouder, a law clerk for the defense during the 1979 trial, said a day or two after Stoeckley testified, she told Rouder that she had in fact been in the MacDonald home during the crime.

Stoeckley said she remembered holding a candle, "only it was not dripping wax, it was dripping blood," Rouder said.

Rouder said she asked Stoeckley why she did not say that on the witness stand and Stoeckley said, "I can't with those damn prosecutors sitting there."

MacDonald's defense contends that the lead prosecutor in the case intimidated Stoeckley into changing her testimony to avoid facing a murder charge herself. The basis for their claim is a sworn statement by a former federal marshal who said he heard the prosecutor threaten Stoeckley.

The former marshal also is dead. Prosecutors have sought to poke holes in his claim, questioning his character and why he waited until 2005 to come forward.

Prosecutors say no evidence supported MacDonald's scenario about intruders killing his family and contend he staged the crime scene to cover his tracks.

Helena Stoeckley's younger brother and Sara McMann, who let Stoeckley live with her shortly before her 1983 death, also testified on Tuesday that she had admitted to being inside the MacDonald home.

McMann said Stoeckley told her she went to the house with some men on the night of the murders and that they only planned to rough up Jeffrey MacDonald. The men had promised Stoeckley that if she went with them "she would become a wizard in the occult group," McMann said.

"She was haunted with nightmares about that," said McMann, who through tears added, "I know as well as I'm sitting here today that Jeffrey MacDonald is innocent."

The hearing, which is expected to last up to 10 days, resumes on Wednesday.

Most diets are an all-or-nothing deal. They are not about constant improvement and a healthy way of living. Some diets cause rapid weight loss, which isn?t necessarily a good idea, either. We are bombarded with pitches for weight-loss gimmicks and fads every day. Ads about the newest machine, pill or diet that will make you thin with no effort are everywhere. Then some people are convinced low-fat is the way to go, while others say low-carb is the best approach. It is no wonder that people are confused and flustered about what to do.??

Let?s look at some of the more popular diets out there today and see why they don?t work, and then talk about how to really be successful.

Protein Diets

High-protein diets are the latest rage. They go by many names, but they all follow a similar formula. They severely limit the consumption of carbohydrates. Advocates of protein diets claim that a body deprived of carbs will burn excess body fat and weight loss will follow. Some of these plans allow unlimited portions of any type of meat, fish, eggs and cheese. A high-protein diet does not permit most carbs such as bread, pasta or potatoes. Weight loss is often substantial in the early period, but the lost weight is water, not fat. Weight loss will then ensue, if and only if the person consumes fewer calories than the body needs.? However, the weight loss includes muscle and water, not fat alone.

When a protein diet is discontinued and carbs are reintroduced, many dieters balloon back to their previous weight or higher. The rebound is not because of the carbs but because of the regain of water weight and continuing to consume excess fatty protein. When limiting vegetables, fruit and grains on a high-protein diet, you also limit nutrients and antioxidants that are crucial for life.

Fasting
Fasting fails to promote weight loss because the body goes into a ?self-preservation? mode and reduces the number of calories (energy) it burns. When the body is deprived of energy sources, it ?anticipates? a shortage in the future and slows the metabolic rate to conserve energy. Repeated fasting causes the body to build up resistance, making weight loss even more difficult after each successive fasting session.

Fasting, or starving yourself for immediate weight loss, can have even more severe side effects that include: vitamin and mineral deficiency, headaches, dizziness, fatigue, nausea, liver and kidney damage and bad breath. Long-term effects can be organ damage, heart damage, muscle loss, and in severe cases, death.

Vegetarian Diets

There are many variations of vegetarian lifestyles. Many people choose not to consume animal foods for health reasons or because of their moral or ethical philosophies. Without care and precise compensation to acquire the needed amino acids from acceptable protein sources or complementary sources, a vegetarian diet can cause the body to become deficient in some critical nutrients. The brain, blood, muscles, tissues and all cells in the body require protein for metabolic activity.

That said, a vegetarian lifestyle is an excellent way to live, and possibly the healthiest lifestyle if managed properly. However, a restrictive and improper vegetarian diet will cause significant health issues.

Possible side effects of a vegetarian diet: vitamin, mineral and various nutrient deficiencies; poor development of the fetus and inadequate milk production; liver and kidney damage; loss of muscle mass; headaches, dizziness fatigue and nausea. External signs of a shortage of protein are dry skin and hair, weak nails and a frail overall appearance.

Liquid Diet Meals

Popularized by celebrities, these diets were all the rage in the late 1980s. In the 1990s, sales plummeted as the same celebrities who promoted the products couldn?t keep the weight off. Now liquid diet meals are enjoying a resurgence in popularity due to the potential for rapid weight loss. But fast weight loss means fast regains and then some. Another issue is the quantity of nutrients supplied. Some liquid meals do not provide the proper amounts of nutrients or calories. If meal replacement shakes are the only food consumed, the effects can be severe.? Each meal replacement shake is different, and each contains a different mix of nutrients. There is no consistency between manufacturers, and there are few regulations.

Conversely, some shakes, especially those protein shakes aimed at athletes and bodybuilders, can provide ten to 1,000 times more of some nutrients than they body needs. This sort of nutrient overconsumption can have a toxic effect on the body. The body may build up toxic levels of nutrients, leaning to organ malfunction with prolonged use.??

High-Fiber Diets

20 to 30 grams of fiber a day is ideal, but is more a good thing? Excessive fiber in the diet can cause constipation and dehydration. Bulk fillers (which are high in fiber) reduce hunger by absorbing fluids and then swelling inside the stomach. This can cause obstructions in the intestinal tract, sometimes even requiring surgery to be relieved. Need I say more?

The Last Word on Dieting

Any diet that minimizes or eliminates intake of any type of nutrient will cause havoc with prolonged use. Switching from diet to diet is even worse. Whether it?s high-protein, low-carb, grapefruit, corn flakes or cabbage soup, that fad diet will not be effective in the end, and it may cause severe side effects.

Being Successful

Don?t count calories. Count portion sizes. The palm of your hand is a built-in measuring device sized to fit the body it is attached to. The size of a serving should be equal to the surface area and the thickness of the palm (excluding fingers).

Your plate should be divided into three, similar-sized potions of vegetables (usually green nutrient sources), protein (typically lean meat), and carbohydrates (typically wheat and grains or fruit). Each third of your plate is a palm-sized portion of each food type.

As a point of reference, these three servings will fill an 8-inch appetizer plate comfortably. To be successful at body-fat loss and weight management, the foods on that plate need to be lean, low in fat, low in calories, and quality foods in appropriately sized portions.

The habit of overeating makes the maintenance or loss of weight impossible. Twenty minutes must pass before the stomach sends signals to the bran to acknowledge food consumption. That delay allows people who eat fast to consume too much before their brain says, ?Enough.? A health-conscious person eats slowly and pauses between bites by putting down their fork, chewing and then swallowing each bite before eating more.?
